Monday, 1 October 2018 promises to be a significant date for the Private Rented Sector (PRS) in Scotland.

Why? As ARLA Propertymark members should be well aware, this is the date by which all those carrying out letting agency work must submit their applications for entry to the Letting Agent Register to the Scottish Government.

I emphasise the words ‘all’ and ‘must’ as it appears there are many agents who will not be in a position to meet this deadline.

The register opened for applications on 31 January 2018. At the end of July there were 400 agents who had started the application process. From that 400, only 73 have been accepted and issued with the Letting Agent Registration number and there are 135 pending (i.e. the relevant checks are being carried out to their application forms and submitted documentation).

The Government’s analysts estimated there were approximately 1,700 agencies/people working in the sector who met the criteria and would be required to register. From the numbers so far, it seems there are many agents who will not meet the deadline, whether that be through poor time management to meet the criteria, ignorance of the regulations or, more concerningly, through willful defiance and their expectation that no enforcement action will be taken against them.

Applications received post deadline will be subjected to a late penalty fee. The defiant agents – or those who don’t think it affects them – can ultimately receive a £50,000 fine or six months’ imprisonment, or both. ARLA Propertymark has been assured that enforcement action will be taken. The Scottish Government has introduced a dedicated telephone line and will investigate all concerns.

As with the constant stream of recent legislative changes in Scotland, this deadline looks certain to have a monumental effect on those operating in Scotland’s PRS.
