Scotland Agent Regulation

Are you ready for regulation?

All letting agents working in Scotland need to understand the Letting Agent Code of Practice and should have taken steps to review policies to ensure compliance by 31 January 2018. A register of letting agents will be introduced and is expected to open early 2018.

Inclusion on the register is expected to require a relevant qualification and ARLA are confident that NFoPP SCQF Level 6 Technical Award in Residential Letting & Property Management (Scotland) will meet the standard.

ARLA works closely with the PRS Policy Team at the Scottish Government to ensure that the coming measures are practical, workable and serve landlords, agents and tenants effectively. We are stressing the need for training to be relevant and affordable.

CLIENT MONEY

To be fully compliant all agents must ensure they hold client money in a dedicated client account. Many agents have found that banks and building societies provide easier access to dedicated accounts for those who are in ARLA membership.

All agents must also belong to a Client Money Protection (CMP) scheme. ARLA membership offers a CMP scheme which meets the levels required in the Code of Practice.
