Scottish Letting Agent Register and Letting Agent Code of Practice

If you are a letting agent working or managing property in Scotland you need to understand the Letting Agent Code of Practice and join the Scottish Letting Agent Register. The Register is now open for applications and the Scottish Government have set an application deadline of 1 October 2018.

The Letting Agent Code of Practice is being introduced with the intention of protecting landlords and tenants and eradicating poor quality housing. It states that it will “help raise standards (where this is needed), and help build a more effective private rented sector that meets the needs of tenants, landlords and letting agents”. Qualifications and training

Registration requires evidence that everyone in your business (who needs to) has the relevant qualification covering the essential aspects of residential letting. The qualification must be SCQF Level 6 or above. More info...

Propertymark Qualifications is one of three training providers so far approved by the Scottish Government. If you achieved the Propertymark Qualifications Level 6 Award in Residential Letting and Property Management within the last three years you will meet the training requirement. If you passed the qualification over three years ago you will need to do 20 hours additional training. More info...

Fit and Proper Person Test

Everyone applying to be on the register will need to meet the standards laid out in a ‘fit and proper person test’. If you are applying on behalf of your company the Scottish Government may need to conduct the test on multiple people within the company. More info...

Client Money Protection (CMP) and professional indemnity insurance

All agencies must ensure they hold client money in a dedicated client account. Many agents have found that banks and building societies provide easier access to dedicated accounts if you are an ARLA Propertymark member.

You must also belong to a CMP scheme and hold Professional indemnity insurance. ARLA Propertymark membership requires that a company has professional indemnity insurance and our CMP scheme meets the levels required in the Code of Practice.

What happens if I do not register?

It will be a criminal offence to carry out letting agency work in Scotland if you are not on the register - with the possibility of fines of up to £50,000 and prison sentences of up to six months for those convicted. More info...

Application Fees

On 30 November 2017, the Scottish Government released the fee structure for the letting agent register. The application fee is for a three year registration and determined by the number of offices your business has where letting agency work is carried out. There are two fee structures depending on whether or not you apply to join the register within the deadline.

APPLICATIONS BEFORE THE DEADLINE

The following application fees apply to existing agents applying before 1 October 2018. It also applys to new agents applying after 1 October 2018 but that have not yet began their letting operations.

LATE APPLICATIONS

The following application fees apply if your business fails to apply by the required deadline of 1 October 2018. The late fees also apply to new business carrying out letting agency work after 1 October 2018 before being admitted to the register.
