ARLA FOI request to Rent Smart Wales

Since the introduction of Rent Smart Wales and concerns over fees ARLA has issued a freedom of information (FOI) request to Rent Smart Wales on the formula used to calculate agents’ licence fee. The text of our FOI is as follows:

Request under Freedom of Information Act 2000

Dear Bethan Jones

Further to the launch of the Rent Smart Wales landlord and agent registration and licensing scheme under the Housing (Wales) Act 2014, the Association of Residential Letting Agents (ARLA) requests of Cardiff Council as the Licensing Authority for Rent Smart Wales, under the Freedom of Information Act 2000:

  1. An explanation of how the Licensing Authority arrived at the agent licensing fee.
  1. What formula, if any, has been used to determine the level of fee.
  1. Whether any consideration was given on a graduated fee structure based on the size of the firm or the number of employees required to be licensed per firm. If so, why such a graduated structure was discounted. If not, why was it not considered and would the Licensing Authority consider revising the fee structure to a graduated model?
  1. Which bodies or individuals (statutory or otherwise) were consulted during the decision making process on the setting of the licensing fee for agents.

All references to the licensing fee within the Freedom of Information Act request, solely refer to the £3,728 Fee applicable to letting agents.
