Changes to Scotland’s landlord registration legislation

The details a landlord must provide when making a valid application for landlord registration or when renewing a current registration will soon be changing.

There is now a requirement on the landlord to confirm by declaration, that, amongst other things the property meets the Repairing Standard and all the relevant safety certificates are in place.

The Private Landlord Registration (Information) (Scotland) Regulations 2019 were laid before the Scottish Parliament on 3 June and these changes will come into force on the 16 September 2019.

It is yet to be seen how each of the 32 local authorities intend to interpret the legislation and how they will monitor their own register.

Will they accept the landlord’s declaration via a checkbox, or will they require evidence the property meets the criteria?
