Are you Fitness for Human Habitation ready?

Fitness for Human Habitation, or FFHH for short, is undeniably the latest buzz word, but how much do you know about the Act and its implications?

Following the passing of the Homes (Fitness for Human Habitation) Act 2018 into law, as of the 20 March 2019 it will be a legal requirement for all social and private sector landlords, or agents acting on their behalf, to ensure that a property is fit for human habitation at the beginning and for the duration of the tenancy.

If a home does not meet the standard of the Housing Health and Safety Rating System (HHSRS), tenants will have the right to take legal action in the courts, for breach of contract.

Properties will be assessed on the following criteria, and will be unfit for habitation if there are serious defects in any of the following:

  • Repair
  • Stability
  • Freedom from damp
  • Internal arrangement
  • Natural lighting
  • Ventilation
  • Water Supply
  • Drainage and sanitary conveniences
  • Facilities for storing/preparing/cooking of food and disposal of waste water
