Industry focus


In May 2019, Pauline McNeill, Labour MSP for Glasgow consulted on the Proposed Fair Rents (Scotland) Bill. If introduced to the Scottish Parliament, the Bill proposes to: Cap private sector rent increases; limit the decision of Rent Officers and the First-tier Tribunal; and require landlords to include rents on the National Landlord Register. ARLA Propertymark responded to the consultation and provided a briefing pack to members to help them respond.

The Private Landlord Registration (Information) (Scotland) Regulations 2019 amends the information which must be provided by the landlord when applying to a local authority. The new Regulations apply to all private landlords with property in Scotland. The Regulations are in force from 16 September 2019.

Since 1 March 2019, the Tolerable Standard found in the Housing (Scotland) Act 1987 has been incorporated into the Repairing Standard. Further amendments to the Repairing Standard will be phased in over the next few years.

A minimum requirement of EPC E will be introduced for all new tenancies from 1 April 2020. All existing tenancies will fall under the rules by 31 March 2022. The Scottish Government has released guidance ahead of the changes coming into force.
